Penalty rates under the SCHADS Award are one of the most significant cost variables in care sector payroll — and one of the most frequently miscalculated.
A critical rule that many providers get wrong: penalty rates are not cumulative. If a worker is on a Sunday afternoon shift, you apply the Sunday penalty rate (200%), not Sunday plus the afternoon loading. Only the highest applicable rate applies.
For shifts spanning multiple penalty rate periods, the rate applicable to the majority of hours worked during the shift generally applies to the whole shift. For public holidays, if a shift starts on the day before a public holiday and extends into it, the public holiday rate applies to the hours actually worked on the public holiday.
Public holidays under the SCHADS Award are determined by each state and territory's public holiday legislation. Different states observe substitution days and additional proclaimed holidays differently. For providers operating across state boundaries, maintaining an accurate, jurisdiction-specific public holiday calendar is essential.
The most common SCHADS penalty rate errors include: applying weekday rates to Saturday or Sunday shifts; treating casual and permanent employees the same on public holidays; using last year's Award rates when Annual Wage Review increases have come into effect; and failing to apply minimum public holiday engagement periods.
