1. Who these terms apply to
These terms apply to visitors to the CareIQ website, organisations requesting a demo or trial, and authorised users who access the platform on behalf of a subscribing organisation.
2. Product evaluation and free trial
CareIQ may offer a free trial period for eligible organisations. Trial access is provided to help you evaluate platform fit and may be limited by time, features, user roles, or implementation scope.
- Trial access may be withdrawn if it is misused or used for unauthorised purposes.
- CareIQ may contact trial users to support onboarding, migration planning, and evaluation.
- Starting a trial does not require CareIQ to continue service beyond the stated evaluation period unless a commercial agreement is reached.
3. Acceptable use
You must not use CareIQ in a way that is unlawful, misleading, abusive, or harmful to the platform, other users, or third parties. You must not attempt to interfere with platform security, scrape restricted data, reverse engineer protected features where prohibited, or use the service to transmit malicious code.
4. Accounts and access
Organisations are responsible for ensuring that only authorised users access their account. Users must keep credentials secure and notify CareIQ promptly if they suspect unauthorised access or account compromise.
5. Customer data and responsibilities
The organisation using CareIQ is responsible for the lawfulness, accuracy, and authority for the data it enters into the platform, including participant, staff, and operational records. CareIQ provides the platform and related workflows, but customers remain responsible for their own legal, clinical, payroll, and compliance decisions.
6. Availability and changes
CareIQ may improve, update, suspend, or modify parts of the platform, website, or trial experience from time to time. While we aim for reliable availability, uninterrupted access is not guaranteed.
7. Fees and subscriptions
Paid use of CareIQ is governed by the applicable pricing, order form, proposal, or subscription agreement in effect at the time of purchase. Public pricing pages are indicative and may change unless incorporated into a confirmed commercial agreement.
8. Intellectual property
CareIQ and its licensors retain all rights in the platform, software, branding, content, and related materials, except for customer data supplied by users. These terms do not transfer ownership of the platform or grant rights beyond the limited right to use it as permitted.
9. Privacy
Your use of the website and platform is also subject to the Privacy Policy. If you are evaluating the product for an organisation, you should also review any customer-facing privacy and data-handling documents supplied during procurement.
10. Warranties and liability
To the extent permitted by law, public website content, trial access, and evaluation materials are provided on an “as is” basis. CareIQ does not exclude rights that cannot be excluded under Australian law, but otherwise limits liability for indirect, incidental, or consequential loss arising from use of the website, evaluation access, or reliance on general informational content.
11. Termination or suspension
CareIQ may suspend or terminate access to website features, demo environments, or trial accounts where misuse, security concerns, or commercial breakdown makes that necessary.
12. Governing law
These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Queensland.
